We study experimentally whether anti-corruption policies with a focus on bribery might be insufficient to uncover more subtle ways of gaining an unfair advantage. In particular, we investigate whether an implicit agreement to exchange favors between a decision-maker and a lobbying party serves as a legal substitute for corruption. We find that even the pure anticipation of future rewards from a lobbying party suffices to bias a decision-maker in favor of this party, even though it creates negative externalities to others. Although future rewards are not contractible, the benefitting party voluntarily compensates decision-makers for partisan choices. In this way, both earn more at the expense of others. Thus, the outcome mirrors what might have been achieved via conventional bribing, while not being illegal. [Copyright Elsevier B.V.]

Während im Zivilprozessrecht mit dem obligatorischen Schlichtungsverfahren (§ 15 EGZPO) die Idee des Vorverfahrens wieder an Bedeutung gewinnt, wird das Widerspruchsverfahren nach §§ 68ff. VwGO in den letzten Jahren von Rechtsprechung und Gesetzgebung zunehmend zurückgedrängt. -- Stefan Vetter unterzieht diesen Prozess einer detaillierten Analyse. Er systematisiert die einzelnen Begründungsansätze und zeigt auf, dass überzeugende Gründe für den Abbau des Vorverfahrens nicht vorliegen. Der Abbau kommt vielmehr einer Demontage gleich. Der Autor wendet sich insbesondere gegen das Verständnis vom Widerspruchsverfahren als "Sachurteilsvoraussetzung" und legt - erstmals in dieser Deutlichkeit - den Wertungswiderspruch der Rechtsprechung in Bezug auf das Vorverfahren nach § 80 Abs. 6 VwGO (Zugangsvoraussetzung) offen. Die Selbstkontrolle der Verwaltung verkommt insgesamt zur Selbstverteidigung. -- Nicht zuletzt vor dem Hintergrund eines in der Praxis ineffektiven Widerspruchsverfahrens entwickelt Vetter ein Konzept zur Reform des - weiterhin notwendigen - Vorverfahrens. Er knüpft dabei an die Idee der Mediation an und skizziert das Grundgerüst eines obligatorischen mediativen Vorverfahrens. Das Konzept ist Ausdruck eines neuen Verwaltungsrechtsverständnisses und einer neuen Verwaltungskultur. Als Teil einer Konfliktinfrastruktur eröffnet es die Perspektive zu einem Vorverfahren als Bürgerverfahren. Die Verwaltung wird zum Konfliktpartner, und der Konflikt wird zur Chance. Neben der Stärkung der Eigenständigkeit der Verwaltung und der Entlastung der Gerichte fördert das mediative Vorverfahren vor allem ein für das Verhältnis Bürger-Staat unabdingbares Element: die Akzeptanz.

Background: Home treatment (HT) is a patient-centred and cost-effective alternative to acute psychiatric inpatient care. However, the progress of its implementation and utilisation in routine care is slow. Aims: The aim of this study was to examine the knowledge and attitude towards HT among healthcare professionals. Method: This observational study included telephone-based semi-structured interviews of 140 referring healthcare professionals including 35 self-referring patients to a large psychiatric hospital in Switzerland during 6 months in 2020. We assessed their knowledge, attitude and experience with HT along with sociodemographic characteristics, professional background and the intention for the referral. We completed the interviews with routine medical data of the referred patients such as diagnoses or symptom severity. Results: Regarding referrals for inpatient treatment (involuntary and voluntary), half of the referring healthcare professionals and 80% of the self-referring patients had no prior experience or knowledge of HT. Knowledge of HT differed in the order of the participants' working places. We found that most participants were uncertain about the inclusion/exclusion criteria for HT. Despite the low levels of knowledge, attitudes towards HT were overall positive. Conclusions: Our results indicate that a proportion of the patients referred for inpatient treatment might have been eligible for HT too. The referring healthcare professionals' and patients' unfamiliarity and uncertainty with HT seems to be an important reason that home-based treatment approaches are still underused, although they are viewed very positively. Besides providing more information to potential referring health professionals, psychiatric hospitals should always carry out a standardized evaluation if HT is an option in patients who are referred for inpatient treatment.

Die kommunale Selbstverwaltung wird durch eine staatliche Aufsicht reguliert. In ihrer Ausgestaltung als Kommunalaufsicht stehen dieser verschiedene Aufsichtsmittel zur Verfügung, um die Gesetzmäßigkeit der Verwaltung sicherzustellen. In der Regel geschieht Aufsicht durch formlose Beratung. Dergestalt können die Aufsichtsbehörden vorsorglich unterstützen oder nachträglich zur Selbstkorrektur anregen. In der Abhandlung werden die Facetten der Beratung beleuchtet. Es wird geklärt, ob ein Beratungsanspruch besteht und wie weit sich ein solcher ggf. erstreckt. Unter Einbeziehung der Ergebnisse einer empirischen Sozialstudie werden relevante Beratungsthemen aufgezeigt. Nach einer Gegenüberstellung der mit der Beratung verbundenen Chancen und Risiken leitet der Autor Handlungsempfehlungen ab, die eine Kommunalberatung unter Beachtung der Selbstverwaltungsgarantie ermöglichen sollen. Schließlich bietet die Abhandlung praxisorientierte Ansätze zur organisatorischen und personellen Umsetzung dieser Empfehlungen
